The City of Stirling has received an application proposing a Residential - Three Grouped Dwellings at 58 Duffy Road CARINE WA 6020.

It should be noted that the intended purpose of the Local Reserve is public open space and the proposal is contrary to the intended use.

Why is this Development Application being advertised to seek public comment?

The City is seeking public comment on this Development Application as it proposes variations to Part 3 – Reserves of Local Planning Scheme No. 3 and Local Planning Policy 4.1 Reserves and Other Zones Design Guidelines.

The City is seeking public comment with regards to the following variations only:

The site is zoned Local Reserve: Public Opens Space under Local Planning Scheme No.3.

The use and development of Local Reserves is controlled by Part 3 – Reserves of Local Planning Scheme No 3.

Part 3 outlines that development on a Local Reserve cannot commence or be carried out without first having obtained planning approval under Part 9 of the Scheme.

In determining an application for planning approval the City is to have due regard to:

  • the matters set out in Clause 10.2;
  • the ultimate purpose intended for the Reserve

What forms of advertising have been carried out?

The City has advertised this application in accordance with the City’s Planning Consultation Procedure.

In addition to advertising the application on the City’s website:

The City has sent letters to landowners/ occupiers within 200m radius in accordance with the City’s Planning Consultation Procedure.
