Please be advised the City is not the decision maker for this application and the application will instead be determined by the Metro North-West Joint Development Assessment Panel (JDAP) due to the value of works.

The City’s role is to provide a recommendation to the JDAP through a Responsible Authority Report (RAR). As part of preparing the City’s RAR to the JDAP we are seeking your comments on the proposal. Your comments will be included within the RAR to ensure that the community’s views have the opportunity to form part of the JDAP’s consideration of the proposal.

The City is seeking public comment on this Development Application as it proposes variations to Stirling City Centre Innaloo Local Development Plan.

The City is seeking public comment with regards to the following variations only:

Stirling City Centre – Innaloo Local Development Plan

Clause 2.1.3.1 Wall Height

  • Two buildings are proposed.
  • The building facing Geneff Street proposes a 15m wall height (4 storeys and a basement level) to the flat roof as measured above average natural ground level (ANGL). A wall height of 9m (3 storeys) is permitted.
  • The building facing Hertha Road proposes a 15.2m wall height (4 storeys and a basement level) to the flat roof as measured above average natural ground level (ANGL). A wall height of 12m (4 storeys) is permitted.

Stirling City Centre – Innaloo Local Development Plan

Clause 2.1.4.2 Side and Rear Setbacks

The following setback variations are proposed:

  • Basement to North setback nil in lieu of the required 3m.
  • Basement to South setback nil in lieu of the required 3m.
  • South Ground Floor setback nil in lieu of the required 3m.
  • North upper Floor setback 3.3m in lieu of the required 4m.
  • South Upper Floor setback nil in lieu of the required 4m.
  • North Second Floor setback 3.3m in lieu of the required 4m.
  • South Second Floor setback Nil in lieu of the required 4m.
  • North Third Floor setback 3.3m in lieu of the required 4m.
  • South Third Floor setback nil in lieu of the required 4m.

Stirling City Centre – Innaloo Local Development Plan

Clause 2.2.3.1 Excavation or Fill and Clause 2.2.3.2 Retaining Walls

  • 1m of retaining and associated fill is proposed to the northern boundary in lieu of a maximum of 0.5m.
