    · The application proposes a boundary wall (garage section) with a compliant length, however an average height of 3.063m in lieu of a 3m average height permitted.

    Clause 5.1.6 – Building Heights/Local Planning Policy 2.6 – Residential Building Heights

    · The application proposes a building wall height of up to 6.27m in lieu of 6m permitted for the Bedroom 3 portion of the front facade. It is noted that building heights are measured from an average of the natural ground levels below the proposed upper floor. The remainder of the upper floor details compliant wall heights of 5.9m, and the overall pitched roof height is 8.4m, with a 9m roof height permitted in the area.

    Clause 5.3.7 – Site Works / Clause 5.3.8 – Retaining Walls

    · Proposed retaining and fill up to 0.7m up to the lot boundary in lieu of up to 0.5m permitted up to the lot boundary. The variation impacts the south eastern corner, extending the existing retaining up to the lot boundary.

    Clause 5.4.1 – Visual Privacy

    · Proposed kitchen window setback 5.254m in lieu of 6m creating overlooking over the existing eastern boundary fence. Screening is generally required to a height of 1.6 from the finished floor level to be considered compliant, however the existing boundary fence will only screen to a height of 1.51m.
